01. Agreement & Scope
Welcome to Forgelnk (referred to as "Forgelnk," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "user," "creator"), and Forgelnk, governing your access to and use of the website [forgelnk.com](https://forgelnk.com), as well as any other media form, media channel, mobile website, or software platform related, linked, or otherwise connected thereto (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.
02. Account Registration & Security
To unlock the full potential of Forge, including custom link creation, dashboard analytics, and media embedding, you must register for an account by providing an authentic email address and selecting a unique profile username. You warrant that all registration information you submit is true, accurate, current, and complete.
You are solely responsible for maintaining the confidentiality of your account password and authentication tokens, and you accept full responsibility for all activities, transactions, and modifications that occur under your account. Forge reserves the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, offensive, or infringes upon third-party intellectual property rights.
03. License, Hosting & Acceptable Use
Forge grants you a non-exclusive, non-transferable, revocable, limited license to access and utilize our drag-and-drop link building platform, smart analytics system, and media players, strictly for personal, artistic, promotional, or legitimate commercial use in accordance with these Terms.
You retain all ownership rights, copyrights, and intellectual property in any music tracks, album art, bios, social links, and rich media assets you upload or publish to your Forge pages ("User Content"). By publishing User Content, you grant Forge a worldwide, non-exclusive, royalty-free, fully paid, perpetual, sublicensable license to host, store, cache, display, stream, and distribute your content across our edge networks to ensure fast delivery to your fans.
You agree not to use the Services to host or distribute material that: (a) is unlawful, defamatory, abusive, threatening, or promotes systemic hate; (b) constitutes copyright infringement or unauthorized distribution of intellectual property; (c) introduces malicious code, viruses, trojans, or tracking scripts; or (d) executes unauthorized bulk scraping, automated indexing, or denial-of-service vectors.
04. Subscriptions, Billing & Cancellations
Forge offers tiered subscription plans (Free, Pro, and Business) to scale your capabilities. Billing is handled securely through PayPal Subscriptions. By subscribing to a paid tier (Pro or Business), you agree to pay the recurring subscription fees displayed at checkout, including any applicable taxes.
7-Day Free Trial Policy: Paid plans may initiate with a 7-day free trial. If a trial is provided, payment authorization is captured upon sign-up, but your selected payment method will not be charged until the trial period expires. To avoid billing, you must cancel your subscription via your dashboard billing panel or PayPal account dashboard before the 7th day ends.
Subscriptions are billed automatically in advance at the start of each renewal period (monthly or annually) until explicitly cancelled. All transactions processed under these Terms are final and non-refundable, except as required under statutory consumer laws or as determined by our support team in exceptional billing scenarios.
05. Forge Proprietary Intellectual Property
Except for User Content, the Services and all source code, databases, backend architecture, layouts, CSS visual frameworks, user interfaces, branding, software algorithms, APIs, graphics, logos, and digital designs contained therein (collectively, the "Forge IP") are owned or licensed by Forgelnk, and are protected by United Kingdom and international copyright, trademark, and unfair competition laws.
You are strictly prohibited from copying, distributing, republishing, reverse engineering, decompiling, or creating derivative works of the Forge IP without our express prior written authorization.
06. Warranties, Liability & Indemnification
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.
IN NO EVENT WILL FORGE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR LOSS OF REPUTATION, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO FORGE DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION ARISING.
You agree to defend, indemnify, and hold harmless Forge, its subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your User Content; (2) your breach of these Terms; or (3) your violation of the rights of a third party, including copyright and intellectual property rights.
07. Governing Law & Jurisdiction
These Terms and your use of the Services are governed by and construed in accordance with the laws of the United Kingdom, specifically England and Wales, without regard to conflict of law principles.
Any legal action, arbitration, or dispute arising out of or in connection with these Terms shall be resolved exclusively in the competent courts of Sheffield, United Kingdom. You hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.
